Sportiqe Apparel LLC (“we”) recognizes and values the protection of your personal information. We believe that this respect is not merely a legal obligation in some instances, but a moral obligation in all instances. 

We also recognize that you may have concerns about any collection of your personal information (also referred to as “Private Data”) acquired by us through our website at www.sportiqe.com (the Website) and how we may use that information.

We have implemented this Privacy Policy in order to inform you about how we will collect, store, use your personal information; under what circumstances we may disclose your personal information; and what your rights are regarding this data.

This Privacy Policy governs the manner in which Sportiqe Apparel LLC collects, uses, maintains, and discloses or shares information collected from users (each, a "User") of the www.sportiqe.com website. This privacy policy applies to the Site and all products and services offered by Sportiqe Apparel LLC.

DEFINITIONS

Personal Data: Personal Data means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).

Usage Data: Usage Data is data collected automatically, either generated by the use of the Site or from the Site infrastructure itself, (such as the duration of a page visit).

Data Controller: Data Controller means a person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal data are or are to be processed. For the purpose of this Privacy Policy, we are a Data Controller of your data.

Data Processor (or Third-Party Website Providers): Data Processor (or Third-Party Website Provider) means any person (other than an employee of the Data Controller) who processes the data on behalf of the Data Controller. We use various Third-Party Providers to facilitate your purchases, shipping, and customer service needs.

Data Subject: Data Subject is any living individual who is the subject of Personal Data.

User: The User is the individual using our Site, also called “the Data Subject.”

INFORMATION COLLECTION AND USE

Personal Identifying Data (“PID” or “Personal Data”)

We may collect PID from Users in a variety of ways, including, but not limited to: when Users visit our site; register on the site; place an order; subscribe to our newsletter; respond to a survey; fill out a form, and in connection with other activities, services, features or resources we make available on our Site. We do not support automated “Do Not Track” functions.

Users may be asked for, as appropriate, name, email address, mailing address, phone number, and credit card information. Users may, however, visit our Site anonymously. We will collect PID  from Users only if they voluntarily submit such information to us. Users can always refuse to personally supply this information. (See, “Your Rights”) below.

In addition, we may record your browser type, the type of computer you are using, your actions on sportiqe.com, any MAC address or other Internet protocol information, as well as review any cookies and other meta-data that may indicate others sites you have visited and technical information about Users’ means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

Web Browser Cookies

Our Site may use "cookies" to enhance User experience. Cookies are text files with small pieces of data — like a username and password — that are used to identify your computer as you use a computer network. Specific cookies known as HTTP cookies are used to identify specific users and improve your web browsing experience.

How We Use Collected Information

Sportiqe Apparel LLC may collect and use Users’ Personal Information for the following purposes:

  • To improve customer service: This information helps us respond to your customer service requests and support needs more efficiently;
  • To personalize User experience: We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site;
  • To improve our Site: We may use feedback you provide to improve our products and services as well as the User experience on our Site;
  • To process payments: We may use the information Users provide about themselves when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service. (See “Third-Party Applications”, below);
  • To run promotions, contests, surveys, or other Site features;
  • To send Users information they agreed to receive about topics we think will be of interest to them;
  • To send periodic emails: We may use your email address to send User information and updates pertaining to their order. It may also be used to respond to their inquiries, questions, and/or other requests. If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. Users may unsubscribe (or “opt-out”) from receiving future emails.     How We Protect Your Information

    We use the most commercially practicable and up-to-date technologies in data collection, storage and processing practices and maintain security measures to help protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site. Sensitive and private data exchanges between the Site and its Users happens over an SSL secured communication channel and is encrypted and protected with digital signatures.

    Sharing Your Personal Information

    We do not sell, trade, or rent Users’ personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.

    We use Third-Party Service providers to help us operate our business and the Site and to administer activities on our behalf, such as sending out newsletters or surveys. We do not receive or have any access to your banking or credit card information, and all transactions involving that data are made possible by our use of certain “Third-Party Services” described below. 

    Retention of Data

    We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

    We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Website , or we are legally obligated to retain this data for longer time periods.     Your information, including Personal Data, may be transferred to, and maintained on computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.     Disclosure of Data: Disclosure for Law Enforcement

    Under certain circumstances, we may be required to disclose your Personal Data if required to do so by law or in response to facially valid requests by public authorities (e.g. a court or a government agency). We are under no obligation to provide you with notice of such requests, although we may do so at our discretion.

    THIRD-PARTY SERVICES

    We use the following Third-Party Services to facilitate commerce, communications, and customer relations, as well as technical facilities to optimize our Site’s functionality:

    • AmazonPay: AmazonPay is an online payments processing service owned by Amazon. AmazonPay uses the consumer base of Amazon.com and focuses on giving Users the option to pay for purchases on our Site with their Amazon accounts. For more information about AmazonPay’s Privacy Policy, click here.
    • Authorize.net: Authorize.net is a subsidiary of Visa Inc. and is a payment gateway service provider, allowing us to accept credit card and electronic check payments through our website and over an Internet Protocol connection.     • Facebook Pixel: Facebook Pixel is a tracking pixel that we use to gather information about a user’s behavior while navigating through our Site. We use it to see what actions users take on the Site so that we can show advertisements to them on Facebook that are likely to be relevant to their interests.     • Google Analytics and Google Ads: Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads on its own advertising network. You can opt-out of your activity being tracked by Google Analytics by installing the Google Analytics opt-out browser add-on.     • Klaviyo: This service is used for collecting and storing User interaction data for the purpose of analyzing trends and integrating that data into other mercantile applications. Their Privacy Policy can be found here.
    • PayPal: PayPal operates an online payment system in the majority of countries that support online money transfers and serves as an electronic alternative to traditional paper methods like checks and money orders, and allows Users to make purchases on our Site.     • ShipStation: ShipStation is an order-fulfillment service that automatically imports orders from all of our sales channels, provides customers access to return labels, manages our product returns, and selects the best carrier service for returns.     YOUR RIGHTS

    We aim to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data. If you wish to be informed what Personal Data we hold about you and if you want it to be removed from our systems or amended, please contact us at info@sportiqe.com.

    You have the right:

    • To access and receive a copy of the Personal Data we hold about you;
    • To rectify any Personal Data held about you that is inaccurate;
    • To request the deletion of Personal Data held about you;
    • To request a copy of your Personal Data in a commonly used electronic format so that you can manage and move it; and
    • To “opt-out” of receiving emails notifying you of special offers, products, events, news, and promotions.

    Please note that we may ask you to verify your identity before responding to such requests.

    Children’s Privacy

    Our Website is not directed to anyone under the age of 13 (“Children”). We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we will take steps to remove that information from our servers.

    Changes to This Privacy Policy

    We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. In addition, we will let you know via email and/or a prominent notice on our Website.
